Warranties and responsibility

WARNING: CharruaSoft SA products are NOT certified for primary diagnosis. They must not be used as the basis for primary diagnostic interpretation.

While CharruaSoft SA delivers high quality products, we do not guarantee that our products are free from defects. We make no warranties regarding performance, merchantability, fitness for a particular purpose, or any other warranties whether expressed or implied.

There are inherent dangers in the use of any software, and the Buyer is solely responsible for determining whether this SOFTWARE PRODUCT is compatible with its equipment and any other software installed on the equipment.

Any image display included in this SOFTWARE PRODUCT is not intended for primary diagnosis. Primary diagnosis must be performed on diagnostic viewing workstations that meet the applicable hardware, calibration, and validation requirements, in accordance with the regulations in force in the jurisdiction where the system is used.

The Buyer is also solely responsible for the protection of its equipment and backup of its data, and under no circumstances shall CharruaSoft SA be liable for direct, indirect, special, incidental, or consequential damages resulting from the use, misuse, or inability to use this software, even if CharruaSoft SA has been advised of the possibility of such damages.

Support and replacement window

Each published version of the SOFTWARE PRODUCT is supported for five (5) years from its release date. After that period CharruaSoft SA has no obligation to provide corrections, updates or technical assistance for that version. The SOFTWARE PRODUCT continues to operate; the licence does not expire.

Licence keys are reissued when a hardware change makes the installed serial number no longer match the licensed one. Reissuance is available for five (5) years from the date of purchase of the licence, and the first reissuance of each licence is provided at no charge. Subsequent reissuances, and any planned migration involving more than two licences, are quoted as a service. After the five-year period the Buyer must acquire a new licence of the current version in order to operate on different hardware.

Limitation of liability

In any event, the total aggregate liability of CharruaSoft SA arising out of or related to the SOFTWARE PRODUCT, under any theory of liability, shall not exceed the amount actually paid by the Buyer for the licence giving rise to the claim.

Governing law and jurisdiction

This agreement is governed by the laws of the Oriental Republic of Uruguay. Any dispute arising out of or related to this agreement or to the SOFTWARE PRODUCT shall be submitted to the courts of Montevideo, Uruguay.
